Christina Aguilera’s BF: DUI Charges Dropped

Hollywoodcrashes previously covered Christina Aguilera getting thrown in jail after her boyfriend was pulled over on suspicion driving under the influence, but most recently, it was reported that her boyfriend, 25-year old Matthew Rutler will not be charged with DUI because it turns out, he wasn’t legally drunk.

Under the law in California, a person is considered legally drunk if he has a blood alcohol content (BAC) of .08 percent. Further, drivers under 21 years old may be convicted of drunk driving even if they have a BAC of .01 percent or higher. It is also considered as illegal for any person to operate a vehicle with a BAC of 0.04% or higher if he drives a vehicle requiring a commercial driver license.

As it turns out, while Aguilera was so drunk she got arrested for public drunkenness, Rutler’s BAC at the time of his arrest is merely .06 percent which is still below California’s legal limit.

The Los Angeles County District Attorney has dropped the case against Rutler on the ground of insufficiency of evidence to prosecute him for driving under the influence of alcohol.

Take note that California’s drunk driving law is also a drug driving law. DUI basically means “driving under the influence of alcohol and/or drugs.” Thus, if you get pulled over for suspicion of DUI, an officer can legally require you to take a blood or urine test. Drivers who refuse these tests are subject to longer license suspensions and revocations.
